Fitters Terms

Fixmyproperty.com affirms that it owns and/or controls all Intellectual Property Rights and Copyrights in and relating to THE SERVICES and the HOME SITE.
1. The term fitter is the person that registers with the company as a trade person.
2. The term "agreed to carry out the works" is once the fitter has lodged on to web site and down loaded the works.
3. The term "web site" is the web site address www.fixmyproperty.com
4. The term company is known as "Fixmyproperty.com".
5. All fitter are to stick to the agreed price set out on the web site for register fitters.
6. The fitter agrees to carry out the works once the fitter has down loaded the works for the web site www.fixmyproperty.com
7. The fitter must be register with the company before the fitter can down load any works.
8. The fitter is to contact the customer with in 48 hour by phone once the fitter has agreed to carry out the works.
9. Any fitter not sticking to the contract is to be struck from our date base for further works and no refund given.
10. The register fitter may NOT pass the works on to a third party.
11. The fitter must be up to date with all insurance before the fitter carries out any works.
12. Any information given to the company at the point of registration must be up dated at all times.

RESALE OF YOUR CUSTOMER SITE OR THE SERVICES:

YOU agree not to sell or resell or THE SERVICES or access to THE SERVICES unless YOU receive prior written agreement from US.

INDEMNITIES:

YOU agree to indemnify and keep indemnified www.fixmyproperty.com and its employees, subsidiaries, affiliates, agents, officers, and other partners, against all costs, claims, expenses and damages or other liabilities of whatever nature incurred by it as a result of any claims or legal proceedings brought or threatened against it, made by any third party due to or arising out of CONTENT which YOU POST on YOUR CUSTOMER SITE, YOUR use of THE SERVICES, YOUR violation of the AGREEMENT, or YOUR violation of any rights of another.

WARRANTIES:

YOU agree that THE SERVICES are provided on an "as is" basis and an "as available" basis and YOUR use of THE SERVICES is at YOUR sole risk. WE make no warranties of any kind or nature, whether expressed or implied, including but not limited to warranties of merchantability or fitness for a particular purpose or use or warranties of error free or uninterrupted performance of computer systems, software, internet software, telecommunications systems, servers, hardware or equipment.

No advice given to YOU by US, or information, whether written or oral obtained by YOU from US, or through YOUR use of THE SERVICES shall create any warranty.

LIMITATION OF OUR LIABILITY:

WE accept no liability to YOU for any loss.
WE shall not be liable for any economic, indirect or consequential loss or damages including, but not limited to loss of profits, contracts, revenue, business or goodwill and/or loss of the use of any equipment or process or loss of operational time or loss of availability or other intangible losses.
WE shall not be liable for any acts or omissions of OUR employees, agents and sub-contractors.
WE shall not be liable for any loss of, damage to or corruption of CONTENT.
WE shall not be liable for any loss arising from the failure of YOUR service provider managing YOUR domain or service.
Any messages that originate from YOUR email address which WE receive will be deemed to be authorised by YOU and WE shall not be liable for any consequence of processing such messages.
The information contained in HOME SITE and THE SERVICES may contain technical inaccuracies or typographical errors. WE shall not be liable for any consequence of such errors.
WE shall not be liable for any event or consequence of force majeure, including but not limited to Acts of God, fire, war, lightening, explosion, disorder, flood, industrial dispute, extremely severe weather or acts of local or central Government or other competent authorities.

In the event that it should prove for any reason ineffective to exclude OUR liability, any such liability shall not be more than the charges paid by YOU to US in accordance with this AGREEMENT and OUR liability will not exceed 25 British Pounds under any circumstances.

SEVERABILITY:

If any provision of this AGREEMENT is judged to be illegal or unenforceable, the continuation in full force and effect of the remaining provisions of this AGREEMENT shall be unimpaired and the AGREEMENT shall not be void for this reason alone. Such an illegal or unenforceable provision shall be replaced by a mutually acceptable legal and enforceable provision.

NOTICES:

Notices to YOU may be made via email or regular mail. WE may also provide notices of changes to the AGREEMENT or other matters by displaying notices or links to notices on the HOME SITE and price up dates.

TERM AND TERMINATION:

This AGREEMENT will commence on the START DATE and end on the EXPIRY DATE. After YOU have purchased a FITTERS REGISTRATION from US, YOU can terminate this AGREEMENT and discontinue use of YOUR FITTERS REGISTRATION and THE SERVICES at any time without any financial penalty. Termination of this AGREEMENT is implied if YOU fail to pay US any monies due in respect of YOUR FITTERS REGISTRATION and THE SERVICES. WE reserve the right to terminate this AGREEMENT with YOU at any time.

CONSEQUENCES OF TERMINATION:

In the event that either party terminates this AGREEMENT:
a) WE will be absolved of all obligations to YOU.

ENTIRE AGREEMENT:

This AGREEMENT and any alterations to the TERMS AND CONDITIONS thereof and any TERMS AND CONDITIONS expressly incorporated into the AGREEMENT constitute the entire AGREEMENT and understanding of the parties. This AGREEMENT shall supersede any previous AGREEMENT, whether written or oral, or any other understanding between YOU and US relating to its subject matter.

TRANSFERABILITY:

YOU may not transfer the benefit and/or burden of this AGREEMENT in whole or in part to any other party.

LAW:

This AGREEMENT is subject to English law and the parties submit to the exclusive jurisdiction of the English courts.
